Who submits the application?

You should submit the application if you intend to reside in the territory of the Republic of Poland for more than 3 months and if the purpose of your destination is the connection with your family.

If you are currently located outside the Republic of Poland and want to join a family member residing in Poland, an application for a temporary residence permit in order to connect with the family should be submitted by a family member on your behalf, whom you will visit. 

The submission of an application for a temporary residence permit in order to connect with the family on behalf of the family member by a foreigner residing on the territory of the Republic of Poland requires the written consent of this member of the family or their legal representative unless the applicant is the legal representative. Expressing the consent is tantamount to granting to a foreigner residing on the territory of the Republic of Poland the power of attorney to act on behalf of a family member in the given proceeding (the template of consent for download).

Temporary residence permit in order to connect with family can be granted to you if you are a member of the family of a foreigner residing in the territory of the Republic of Poland:

  1. on the basis of a permanent residence permit,
  2. on the basis of a residence permit for a long-term resident of the EU
  3. in connection with granting a refugee status to them,
  4. in connection with the granting of subsidiary protection to them,
  5. at least for a period of 2 years on the basis of subsequent permits for temporary residence, including immediately before the request for their temporary residence permit for a member of the family – on the basis of a license issued to them for the period of residence of not less than 1 year,
  6. on the basis of a temporary residence permit, in order to perform scientific research,
  7. on the basis of a temporary residence permit granted for the purposes of scientific research, when the foreigner has a residence permit referred to in article 1 paragraphs 1 and 2. 2 (a) of Council Regulation No. 1030/2002, bearing the heading "scientist", issued by another Member State of the European Union, if the agreement to adopt a foreigner for the purpose of the research project concluded with the appropriate scientific unit of that Member State provides for a scientific research on the territory of the Republic of Poland,
  8. on the basis of a temporary residence permit in order to work in an occupation that requires high qualifications,
  9. on the basis of a temporary residence permit granted to perform work within the framework of intra-corporate transfers,
  10. on the basis of a temporary residence permit granted in order to use the long-term mobility,
  11. in connection with the granting of a residence permit for reasons of working in a profession requiring high qualifications, humanitarian qualifications.

The member of a family will be considered as:

  1. a person married with the foreigner, (the marriage must be recognized by the law of the Republic of Poland); 
  2. a minor child of the foreigner and the person whom they are married with (the marriage must be recognized by the law of the Republic of Poland; 
  3. In a marriage, including the adopted child;
  4. minor child, including an adopted child, dependant, over whom the foreigner has actually parental authority;
  5. minor child of a person referred to in paragraph 1, including the adopted child, dependent on them, over which they actually exercise parental authority.

 

When should I submit the application?

You must submit the application for a temporary residence permit and work in person, no later than on the last day of legal residence in the territory of the Republic of Poland. 

In the event of lack of the possibility of personal appearance, please send the application via post.

For the sake of preservation of legal residence, the date of postage at the post office will be considered. 

If you submit an application within the time limit and it does not include any formal deficiencies, or you complete the deficiencies within the period indicated by us, your residence will be legal from the date of submission of the application until the date on which the decision, in this case, will become final.

If you apply for a suspension of the proceedings on granting of temporary residence permit, your stay at this time will not be considered legal.

    After coming to the Office approach the ticket machine of the line management system, type in the reservation number, get the ticket and wait for your number to be called out and once it is, approach the indicated post.

Remember to enter your valid place of stay in the application form. Having sent the application form by means of post you will be called for appearance in person in order for your fingerprints to be taken. You must appear in person at the headquarters of the Lower Silesian Provincial Labour Office or in one of its Delegation Offices, approach the ticket machine of the line management system and select the ticket “appearance in person”.

NOTE: If you wish to register your fingerprints without being called by the Office, you can do so not earlier than from the day of application form submission.

REMEMBER: registering of the account on the Information Portal - https://przybysz.duw.pl,  filling out the application on-line in the system, printing it out and submitting in the Office may make proceeding process of your application shorter and will allow you to monitor your case!

 

What documents must I submit?

  1. Completed application and its 2 copies. Before completing the application, read the instructions in the application. Application for a temporary residence permit.
  2. Four photos:
    • Not destroyed, colour, sharp;
    • Size 35 mm x 45mm;
    • Made no earlier than within 6 days before the day of submitting the application;
    • Depicting the face of a foreigner from the top of the head to the upper part of shoulders so that the face is visible within 70-80% of the photo, on the uniform background;
    • Depicting the person looking straight ahead, with eyes open, not covered by hair, with natural expression and mouth closed, and showing natural skin colour;
    • Depicting eyes of the foreigner, especially the pupils and the sight line of the foreigner should be parallel to the upper edge of the photo;

    Caution: Foreigner using head covers according to the rules of his religion may add a photo to the application depicting him in the head cover on condition that the face is visible. In such a case a declaration of the foreigner will be needed that he belongs to a certain religious commune. Declaration of belonging to religious commune.

  3. Copy of a valid travel document (original for insight). In particularly justified cases, when the foreigner does not have a valid travel document and it is not possible to obtain one, they can present other evidence of identity (e.g. residence permit card).
  4. The written consent of a foreigner who resides outside of the Republic of Poland for submitting for them an application for a temporary residence permit by a member of the family residing in the territory of the Polish Republic (template approval )
  5. Confirmation of stamp duty payment

    NOTICE: Submission of the above documents is necessary for initiation of the procedure. In the event of submission of the application without any of the above documents, the foreigner will be appointed to supplement the formal deficiencies in the application. The proceeding may be initiated only after completing the missing documents within an indicated period and post their positive verification by the Office.

    IN ADDITION, TO OBTAIN A POSITIVE DECISION DUE TO THE PERFORMANCE OF WORK IT WILL BE NECESSARY TO INCLUDE ALSO THE FOLLOWING DOCUMENTS:

  6. the documents proving confirmation of the possession of formal health insurance within the meaning of the provisions of the Act of 27 August 2004 on health care benefits financed from public funds or confirmation of coverage by the insurer's medical costs on the territory of the Republic of Poland (e.g. appropriate certificate from Social Insurance Institution, insurance policy)
  7. a document proving confirmation that you have an ensured place of residence (e.g. registration, lease agreement, a statement of the person entitled to the possession of premises providing the residence for a foreigner)
  8. confirmation of the stable and regular source of income sufficient to cover the costs of maintenance of yourself and family members recognized as dependants (for a single person – 701 PLN net per month, for a person in the family – in the amount of 528 PLN net per month)
  9. Information on the number of persons remaining as your dependants Declaration of the number of dependant persons
  10. evidence of relationship
  11. possession of the authorisation required by law by a family member with whom you are going to reside.

NOTICE: Attaching to the application all mentioned documents can speed up your case and limit the amount of correspondence sent to you. In case it is necessary to provide clarification in your case as to the evidence possessed by the authority, you may be asked to provide additional documents or to provide explanations.

Documents should be submitted in originals or photocopies along with originals for insight. Civil status acts proving the relationship or marital status issued by foreign countries should bear apostille clause or be confirmed by the Polish Consul. If the application is accompanied by the documents prepared in a foreign language, also their translation into the Polish language made by a sworn translator is required.

 

What are the fees?

Stamp duty for issuing temporary residence permit in order to carry out economic activities is: 340,00 PLN

When and where can I collect my residence card?

After obtaining the permission (decision regarding temporary residence), in order to obtain the residence card, you should submit:

  1. Confirmation of payment for the card (50 PLN)
  2. Valid confirmation of registration of residence for the temporary residence longer than 2 months – if your address is to be placed on the card or else you ought to submit a written declaration when your card should be issued without the address. Declaration of printing a card without the address.

In case of not submitting the above mentioned confirmation of registration of residence within 14 days from the day of collection of the decision about permission for temporary residence, data about the address will not be included in the card.

Remember:

residence card may be collected only in person at the Department of Civic Matters and Foreigners at pl. Powstańców Warszawy 1, in Wrocław.
