Who submits the application?

You can submit the application if:

  • You have Polish origins and you want to live on the Polish territory permanently or you have been married to a Polish citizen for more than 3 years before the day of submission of the application to obtain permission for permanent residence  and directly before submitting this application you stayed on the Polish territory for at least 2 years with no break, based on the permission for stay issued connected to being married to a Polish citizen or connected to getting refugee status, supplementary protection, or permission for stay due to humanitarian reasons, or
  • You are a victim of human trafficking and you meet the conditions of the Act on foreigners, or
  • Directly before submitting the application for permanent residence  you stayed with no breaks on Polish territory for no less than 5 years on the basis of refugee status, supplementary protection or permission for stay due to humanitarian reasons, or
  • Directly before submitting the application for permanent residence you stayed with no breaks on the Polish territory for no less than 10 years on the basis of the permission for tolerated state or you were granted an asylum on the territory of Poland.
     

The application may also be submitted by parents established by the court or one of the parents established by the court on behalf of the juvenile child if:

  • the child is a child of a foreigner who was granted a permission for permanent residence  or permission for a long-term EU resident stay under his parental supervision;
  • the child is born after this foreigner is granted permission for permanent residence  or permission for long-term EU stay, or
  • the child born in the period of validity of permission for temporary residence granted to this foreigner, or in the period of this foreigner’s stay on Polish territory based on the permission for the stay due to humanitarian reasons, permission for the tolerated stay,  refugee status, supplementary protection, or 
  • the child is a child of Polish citizen staying under his parental supervision.

 

When should I submit the application?

The application for permission for permanent residence should be submitted no later than on the last day of your legal stay on the Polish territory.

In case you cannot submit the application in person, please send the application by post.

In order to meet the deadline for legal stay, the date of mailing the application is taken into account.

If you submit the application on time, and there will be no formal deficiencies in it or the deficiencies will be supplemented by you during the time indicated by the Office, your stay will be legal from the day of submitting the application until the day that decision in this case becomes effective.

If you submit application for suspending the permission for temporary residence, your stay will be treated as illegal during this time.

 

How can I submit my application form?

  1. In person after previously booking a visit at https://rezerwacje.duw.pl/reservations/ or in person after previously filling out the application on-line, printing out and making a reservation of the visit at https://przybysz.duw.pl
    On Monday, Tuesday, Thursday and Friday 9:00 a.m. – 4:00 p.m.; Wednesday 8:00 a.m. – 6:00 p.m.

    After coming to the Office approach the ticket machine of the line management system, type in the reservation number, get the ticket and wait for your number to be called out and once it is, approach the indicated post.

Remember to enter your valid place of stay in the application form. Having sent the application form by means of post you will be called for appearance in person in order for your fingerprints to be taken. You must appear in person at the headquarters of the Lower Silesian Provincial Labour Office or in one of its Delegation Offices, approach the ticket machine of the line management system and select the ticket “appearance in person”.

NOTE: If you wish to register your fingerprints without being called by the Office, you can do so not earlier than from the day of application form submission.

REMEMBER: registering of the account on the Information Portal - https://przybysz.duw.pl,  filling out the application on-line in the system, printing it out and submitting in the Office may make proceeding process of your application shorter and will allow you to monitor your case!

 

What documents should I submit?

  1. Filled out application and its 2 copies. Before filling out the application, familiarize yourself with the, instruction in the application. Application for permission for permanent residence .
  2. Four photos:

    Caution: Foreigner using head covers according to the rules of his religion may add a photo to the application depicting him in the head cover on condition that the face is visible. In such a case a declaration of the foreigner will be needed that he belongs to a certain religious commune. Declaration of belonging to religious commune.

    • Not destroyed, colour, sharp;
    • Size 35 mm x 45mm;
    • Made no earlier than within 6 days before the day of submitting the application;
    • Depicting the face of a foreigner from the top of the head to the upper part of shoulders so that the face is visible within 70-80% of the photo, on the uniform background;
    • Depicting the person looking straight ahead, with eyes open, not covered by hair, with natural expression and mouth closed, and showing natural skin colour;
    • Depicting eyes of the foreigner, especially the pupils and the sight line of the foreigner should be parallel to the upper edge of the photo;
  3. Copy of the valid passport (original for viewing). In especially justified cases when the foreigner does not have a valid passport and has no possibility of obtaining one, he can present other identification document (e.g. Residence card).
  4. Confirmation of payment of the stamp duty.

    Caution: Submitting the above mentioned documents is necessary to start the process. In case of submitting the application without any of the above documents, the foreigner will be asked to supplement the formal deficiencies in the application. The process may be started only after the unsubmitted documents are submitted in the determined time and after they are positively verified by the Office.

    WHAT IS MORE, FOR ISSUANCE OF POSITIVE DECISION REGARDING WORK IN PROFESSIONS REQUIRING HIGHER PROFESSIONAL QUALIFICATIONS, IT IS NECESSARY TO ENCLOSE ALSO THE FOLLOWING DOCUMENTS:

  5. In case you have Polish origins:
    • originals of documents confirming Polish origins by one of your parents, grandparents or both great grandparents,
    • documents confirming your relationship with a person having Polish origins (in case of presenting for the records copies of the documents confirming Polish origins, the above mentioned documents
    • should be supplemented by the apostille information),
    • certification of paying tax obligations to Polish government,
    • certification of lack of criminal record on Polish territory.
  6. In case you are married to a Polish citizen:
    • Current transcript of the Marriage Certificate (issued no earlier than 3 months before submitting the application),
    • Copy of partner’s ID.
  7. In case of having children - transcripts of birth certificates,
    • Certification of meeting tax requirements of the Polish government,
    • Certification of lack of criminal record on the Polish territory;
  8. In case of child being a child of foreigner having a permission for permanent residence  or stay of long-term EU resident, staying under his parental supervision and born after the foreigner was granted permission for permanent residence  or stay of long-term EU resident:
    • Transcript of birth certificate,
    • Copy of decision of granting permission for permanent residence  or stay of long-term EU resident or residence card of statutory representative
  9. In case of child of a Polish citizen staying under his parental supervision:
    • Transcript of birth certification,
    • Copy of ID of statutory representative;
  10. In case of a victim of human trafficking:
    • Documents confirming cooperation with police in criminal proceedings in the case regarding a crime under article 198a, paragraph 1 of the Penal Code and reason for fear of coming back to one’s own country, confirmed by the prosecutor leading the criminal proceeding,
    • Certification of meeting the tax requirements towards the Polish government. 
  11. In case when directly before submitting the application you stayed, without breaks, on the Polish territory for no less than 5 years based on the refugee status, supplemental protection or permission for stay due to humanitarian reasons:
    • Documents confirming the required, 5-year, continuous stay in Poland,
    • Certification of meeting the tax requirements towards the Polish State Treasury,
    • Certification of lack of criminal record on the Polish territory;
  12. In case when directly before submitting the application you stayed, without brakes, on the Polish territory for no less than 10 years based on the permission for tolerated stay issued on the basis of article 351 item 1 or 3 of the Act on foreigners:
    • Documents confirming the required, 10-year, continuous stay in Poland,
    • Certification of meeting the tax requirements towards the Polish State Treasury,
    • Certification of lack of criminal record on Polish territory;
  13. In case when you were granted asylum in the Republic of Poland:
    • Document confirming granting the asylum,
    • Certification of meeting the tax requirements towards the Polish State Treasury,
    • Certification of lack of criminal record on Polish territory.

Caution: Attaching all the above mentioned documents to the application form may contribute to faster consideration of your case and limit the amount of correspondence addressed to you. In case of a need for clarification of the evidence gathered by the Office in your case you may be asked to submit additional documents or submit clarifications.

Documents should be submitted in original form or as copies with originals available for review. Vital records confirming kinship or civil status issued by the foreign states will have additional clause or apostille confirmed by the Polish consul. If the documents attached to the application are in a foreign language, it is obligatory to submit a translation of such documents into Polish made by a sworn translator.

 

What are the fees?

Stamp duty for issuing uniform permission for permanent residence and work is: 640,00 PLN

When and where can I collect my residence card?

After receiving the permission (decision for permanent residence) in order to receive the card you should submit:

  1. confirmation of payment for residence card (50 PLN)
    The 50% discount from the payment can be obtain by foreigners:
    • who are in difficult financial situation,
    • whose goal of stay is to learn in high school or university on the Polish territory,
    • juveniles who on the day of submitting the application TO OBTAIN or exchange the card are not above 16 years old.
  2. valid confirmation of registration of residence for the temporary residence longer than 2 months – if your address is to be placed on the card or else you ought to submit a written declaration when your card should be issued without the address. Declaration of printing a card without the address.

In case of not submitting the above mentioned confirmation of registration of residence within 14 days from the day of collection of the decision about permission for temporary residence, data about the address will not be included in the card.

Remember:

residence card may be collected only in person at the Department of Civic Matters and Foreigners at pl. Powstańców Warszawy 1, in Wrocław.
